Terms of Use — TackleIQ

Please read these Terms of Use ("Terms") carefully before using the TackleIQ mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. About TackleIQ

TackleIQ is an AI-powered fishing companion that helps anglers catalog their tackle, receive personalized lure recommendations, and connect with a community of fellow anglers. The App is operated by Jason Biggar.

2. Account Registration

To use TackleIQ, you may create an account using Apple Sign-In or passwordless email authentication.

You are responsible for maintaining the security of your account credentials.
You must provide accurate and complete information when registering.
You must be at least 13 years of age to create an account.
You are responsible for all activity that occurs under your account.
Notify us immediately at support@tackleiq.ai if you suspect unauthorized access.

3. Subscriptions and Payments

TackleIQ offers optional premium features through auto-renewable subscriptions billed through the Apple App Store.

Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
To manage or cancel your subscription, go to your device Settings → Subscriptions.
No refunds are provided for partial subscription periods.
Pricing may vary by region and is displayed at the time of purchase.
TackleIQ does not process payments directly; all billing is handled by Apple.

4. AI-Powered Features

TackleIQ uses artificial intelligence to provide tackle recommendations and other features. These recommendations are for informational purposes only.

TackleIQ makes no guarantee of fishing success.
Results vary based on conditions, equipment, technique, local regulations, and other factors.
AI recommendations do not substitute for your own judgment as an angler.

5. Community Guidelines and User-Generated Content

Zero Tolerance Policy

TackleIQ has zero tolerance for objectionable, abusive, or harmful content. All users are expected to maintain a respectful, safe community for anglers of all experience levels.

Prohibited Content

You may not post, share, or transmit content that:

Is obscene, pornographic, or sexually explicit
Promotes violence, harassment, bullying, or threats
Contains hate speech or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
Is illegal or promotes illegal activities
Infringes the intellectual property rights of others
Contains spam, misleading information, or commercial solicitation
Depicts animal cruelty or promotes harmful fishing practices
Impersonates another person or entity

Content Moderation

TackleIQ provides tools for users to report objectionable content and block abusive users. Reports are reviewed and acted upon within 24 hours. Actions may include removing content and suspending or permanently banning accounts. TackleIQ reserves the right to remove any content and terminate any account at its sole discretion, without prior notice.

Your Content

You retain ownership of content you post to TackleIQ. By posting, you grant TackleIQ a non-exclusive, worldwide, royalty-free license to display your content within the App for community features. You may delete your content at any time from within the App.

6. Acceptable Use

In addition to the Community Guidelines above, you agree not to:

Access accounts, data, or systems not intended for you
Interfere with or disrupt the App or its servers
Reverse engineer, decompile, or attempt to extract the App's source code
Use the App for any illegal purpose or in violation of any applicable law
Create multiple accounts to circumvent account limits, suspensions, or bans
Use automated tools, bots, or scrapers to access the App

7. Account Deletion

You may delete your TackleIQ account at any time by going to Profile → Delete Account in the App.

Account deletion is permanent and cannot be undone.
Deletion removes all data associated with your account, including tackle inventory, catch logs, and community posts.
Deleting your account does not automatically cancel active subscriptions — you must cancel separately in Settings → Subscriptions.

8. Privacy

Your use of TackleIQ is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your information.

9. Affiliate Links

The App may include affiliate links to third-party retailers, including Amazon and Bass Pro Shops. TackleIQ may earn a commission when you make a purchase through these links, at no additional cost to you. TackleIQ is not responsible for the products, services, or policies of third-party retailers.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TackleIQ does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your own risk.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TACKLIQ AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by updating the Effective Date at the top of this page. Your continued use of TackleIQ after any changes constitutes your acceptance of the revised Terms.

13. Termination

TackleIQ reserves the right to suspend or terminate your account at any time for violations of these Terms, particularly violations of the Community Guidelines in Section 5. You may stop using the App and delete your account at any time as described in Section 7.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
